A person may commit health care fraud, (18 U.S.C. § 1347), if the person engages in a scheme to defraud a health care benefit plan, including Medicare, Medicaid, private insurance companies, or a managed care plan. The methods used to accomplish health care fraud may also take many forms, including:

  • Phantom Billing – Billing for Services Never Performed
  • Patient Recruiting
  • Kickbacks or Improper Rebates to Physicians
  • False or Fraudulent Claims to Insurance Companies
  • Billing for Medically Unnecessary Procedures or Tests
  • False Documentation
  • Upcoding
  • Illegal Dispensation of Medications

If you have been accused of a health care fraud offense or if you have reason to believe that you may be the subject of a health care fraud investigation, it is important to contact an experienced health care fraud defense attorney. Contacting a health care fraud defense attorney is also significant because typically health care fraud investigations run parallel to civil investigations conducted by the Civil Division of the Department of Justice in connection with, or as a result of, the filing of a complaint alleging a violation of the False Claims Act (also known as a qui tam complaint).
